This document replaces prior versions of our Terms of Use once it becomes effective. If any portion conflicts with platform terms from Apple or Google, those platform terms control to the extent of the conflict.

1. Who we are & what these Terms cover

These Terms of Use (the “Terms”) govern your access to and use of the PlanBead mobile application and related services (collectively, the “App”), provided by PlanBead (“PlanBead“, “we“, “us“). By using the App, you agree to these Terms.

If you access the App on an Apple device and we do not provide a custom EULA in the App Store listing, Apple’s Standard EULA applies in addition to these Terms. If you access on Android via Google Play, Google Play’s terms also apply.

2. Account & eligibility

  • You must be at least 13 years old (or the age of digital consent in your country, if higher). If you are under the age of majority, you must have consent from a parent or legal guardian.
  • You are responsible for all activity under your account and for keeping your login credentials secure.

3. Your content

The App allows you to create, upload, and synchronize bead designs and related materials (“Content”). You retain any ownership rights in your Content. You grant PlanBead a non‑exclusive, worldwide, royalty‑free license to host, store, transmit, display, and back up your Content solely to operate the App (e.g., cloud sync, rendering, previews, troubleshooting, and backups). You are responsible for your Content and for obtaining all necessary rights.

4. In‑App Purchases, Subscriptions, and Virtual Currency (Gems)

4.1 Where billing happens

All purchases of digital goods (including subscriptions and Gems) are processed by the Apple App Store or Google Play using their billing systems. PlanBead does not collect or store your full payment details.

4.2 Subscriptions (auto‑renewing)

We offer auto‑renewing subscriptions that unlock premium features and a monthly Gem allowance:

  • Gold (Monthly): includes a monthly Gem allowance.
  • Platinum (Yearly): includes a larger monthly Gem allowance.

Subscriptions renew automatically unless canceled in your store account settings before renewal. You can manage or cancel at any time in your App Store / Google Play account settings. Pricing and duration are shown in‑app and may vary by region/tax. If a subscription price changes, the store may require your consent; otherwise, auto‑renew will be turned off. Access continues until the end of the current paid period after cancellation.

Any free trial or introductory offer, if provided, will convert to a paid subscription unless you cancel before the end of the promotional period. Where permitted, any unused portion of a free trial is forfeited upon purchase.

4.3 Gems (virtual currency)

Gems are an in‑app virtual currency with no cash value, non‑redeemable for cash, non‑transferable, and usable only within the App. Gems may be purchased via in‑app purchase, granted as part of a subscription, or awarded through promotions.

  • Purchasing Gems: We may offer Gem packs (e.g., 5/10/20/50/100 Gems or other amounts displayed at checkout). Gem purchases are delivered to your in‑app balance when the store confirms your transaction.
  • One‑time starter grant: New accounts may receive a one‑time starter grant up to 20 Gems. Eligibility may be limited to accounts created within the last 180 days. We may deny or revoke the grant for suspected abuse.
  • Refunds and adjustments: Gem purchases are generally non‑refundable once delivered, except where required by law or the applicable app store’s policies. If a transaction is reversed (e.g., refund/chargeback), or if an error or fraud is detected, we may adjust your Gem balance accordingly.
  • No transfer/out‑of‑app use: Gems cannot be gifted, transferred, or used outside the App. Selling or exchanging Gems is prohibited.
4.4 Monthly Gem allowance for subscribers

Subscribers receive a monthly allowance of Gems credited to their balance:

  • Gold (Monthly): at least 10 Gems per calendar month.
  • Platinum (Yearly): at least 30 Gems per calendar month.

How the allowance works: On or after the start of each calendar month (UTC), we ensure your balance is at least the allowance for your tier (we call this a “top‑up”). If your balance is already above the allowance, no additional Gems are added for that month. We may require you to open the App or trigger an in‑app “Top up” action to receive the monthly ensure. Records of the month and tier may be stored to prevent duplicate top‑ups.

The allowance does not accrue or carry over beyond ensuring a minimum balance. If your subscription expires or is canceled, the allowance stops. Your existing Gem balance remains unless adjusted for fraud/error.

4.5 Spending Gems

Gems can currently be used for:

  • 3D rendering previews: 1 Gem per preview.
  • Unlocking premium patterns: Gold designs cost 5 Gems; Platinum designs cost 10 Gems.

We may add new Gem uses or change the Gem cost of features over time (see §11).

5. Acceptable use

You agree not to misuse the App, including by infringing others’ rights, attempting to reverse engineer, interfering with security, or engaging in fraud, spam, or illegal activity. We may suspend or terminate accounts that violate these Terms.

6. Intellectual property

Other than your Content, the App and its content are owned by PlanBead and its licensors and are protected by intellectual‑property laws. PlanBead grants you a personal, non‑exclusive, non‑transferable, revocable license to use the App in accordance with these Terms and applicable store terms.

7. Termination

You may stop using the App at any time. We may suspend or terminate access to the App (including removing or adjusting Gem balances) if we reasonably believe there is a breach of these Terms, unlawful conduct, or fraud. Termination does not entitle you to a refund except where required by law or by the applicable app store.

8. Disclaimers

The App is provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, PlanBead disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not guarantee error‑free or uninterrupted operation or that the App will meet your requirements.

9. Limitation of liability

To the maximum extent permitted by law, PlanBead and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from your use of the App, even if we have been advised of the possibility of such damages. Our aggregate liability for all claims relating to the App will not exceed the amount you paid to us for the App in the 12 months preceding the claim (excluding amounts paid to the app stores).

Some jurisdictions do not allow certain limitations; in that case, those limitations apply to the maximum extent permitted by law.

10. Governing law & venue

These Terms are governed by the laws of Greece (without regard to conflict‑of‑laws rules). The courts located in Athens, Greece will have exclusive jurisdiction, except that consumers may have additional mandatory rights in their country of residence. Nothing herein limits any non‑waivable consumer rights.

11. Changes to the App, Gem program, and pricing (important)

PlanBead is a new service. We may modify, limit, suspend, or discontinue any feature of the App — including Gem pricing, subscription tiers, monthly Gem allowances, and the Gem cost of features — at any time for business, technical, or legal reasons. Where required by law or platform policy, we will provide appropriate notice (e.g., in‑app notices or release notes) and obtain any necessary consent via the App Store or Google Play (for example, in the case of subscription price increases). If you do not agree to changes, you should cancel your subscription before the next renewal and stop using the App.
